Referral Reward Terms and Conditions
1. The Kooindah Waters Resident and Golf Members Referral Program allows you (Referrer) to encourage friends and family (Prospective Owner and/or Prospective Golf Member) to join the Kooindah Waters Golf Club, purchase a block of land or to purchase a completed home at Kooindah Waters (Promotion). By participating in the Referral Program, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
2. The Promoter is Clarendon Resort Housing Pty Ltd ABN 35 098 260 229.
3. The Promotion starts 23 December 2010 and ends on 31 December 2011 or such earlier date as may be determined by the Promoter (Offer Period).
4. The Referral Reward is any one of the following:
a. $2,500 Lifestyle Voucher, if you refer someone who completes the purchase a resort lot at Kooindah Waters from the Promoter;
b. $5,000 Lifestyle Voucher, if you refer someone who completes the purchase of a golf course lot, golf view lot or completed home on a golf course lot or golf view lot at Kooindah Waters from the Promoter;
c. $500 Lifestyle Voucher, if you refer someone who goes on to join the Kooindah Waters Golf Club as a full playing member including the upfront payment of a full external joining fee.
5. Separate terms and conditions apply in respect of the supply of Referral Rewards.
6. To be eligible for and receive the Referral Reward, the Referrer must:
a. be the legal owner of an Investa Residential Property sold to the Referrer by Investa prior to the Offer Period (Existing Owner) and/or be a financial member of the Kooindah Waters Golf Club (Existing Golf Member);
b. refer a Prospective Owner or Prospective Golf Member to the Promoter within Offer Period and that person or couple must not already be in the Promoter’s database or currently in residential purchase or golf club joining negotiations with the Promoter (or its related entities); and
c. the Prospective Owner or Prospective Golf Member (as the case may be) must enter into a binding contract to:
i. purchase Investa Residential Property, (being a property referred to in clause 4 above), pay the purchase price and otherwise comply with the terms and condition of that contract within 12 months of the referral by the Referrer; or
ii. purchase a Kooindah Waters Golf Club Membership (being the golf membership referred to in clause 4 above) (Membership) and pay the joining fee otherwise comply with the terms and condition of that contract within 3 months of the referral by the Referrer.
7. A Referrer’s eligibility for a Referral Reward is subject to the Promoter confirming that the Prospective Owner and/or Prospective Golf Member is a new introduction prior to the Prospective Owner and/or Prospective Golf Member contacting the Promoter. The Promoter reserves the right to verify the validity of all referrals and the eligibility of a Referrer to receive the Referral Reward.
8. Financial planners, real estate agents or those otherwise engaged in similar business are not eligible for the Promotion.
9. In the event that a couple or person is referred by two Existing Owners and/or Existing Golf Members, only the first Existing Owner /or Existing Golf Member to refer the couple or person will be eligible to receive the Referral Reward, as determined by the Promoter in its absolute discretion.
10. The Referral Reward will be provided to the Referrer following the Prospective Owner completing (ie settling) its purchase of Investa Residential Property in accordance with the terms and conditions of the contract for sale and/or the Prospective Golf Member purchasing a Membership, including payment upfront of a full joining fee, in accordance with the terms and conditions of membership (Redemption Event).
11. If the Referral Reward is not redeemed within 1 month of the relevant Redemption Event, it expires and no amount may be claimed by the Referrer from the Promoter. If for any reason the Referrer does not redeem the Referral Reward or we are unable to contact you, the Referral Reward will be forfeited. Any part of the Referral Reward that has not been fully redeemed by the date which is 12 months from the Redemption Event will be forfeited and no amount may be claimed by the Referrer from the Promoter.
12. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
a. to disqualify any individual; or
b. to modify, suspend, terminate or cancel the promotion, as appropriate.
13. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion including, but not limited to, where arising out of the following:
a. any theft, unauthorised access or third party interference;
b. any correspondence that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
c. any tax liability incurred by a Referrer as a result of receiving the Referral Reward; or
d. inability to use the Referral Reward.
14. The Promotion is not available in conjunction with any other promotion or offer by Promoter or any of its related entities.
15. The Promoter may cancel or make changes to the Promotion at any time without notice.
16. The Referrer may not deduct or set off the Referral Reward from any moneys or debts payable to the Promoter.
17. These terms and conditions supersede any prior terms and conditions for the Promotion.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, and contractor. Participation is conditional on providing this information. Individuals should direct any request to access, update or correct information to the Promoter.
Clarendon Resort Housing Pty Ltd ABN 35 098 260 229 uses the information you provide in the Registration of Interest form in accordance with our Privacy Policy to contact you with respect to your interest in Kooindah Waters Referral Program including by email and phone.
We may disclose the information to others including Mercure Kooindah Waters, Kooindah Waters Golf Club and/all Endota Spa or as permitted by the Privacy Act 1988.
